Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The situation originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in immigration detention.
In her decision, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
